Terms and conditions of sale
Terms applying to equipment, photography lessons and gift vouchers ordered and paid for on this site.
1. Scope
These terms govern the services sold at a distance on this site: photography lessons and the gift vouchers that give access to them. Any booking or purchase implies their acceptance, expressed by ticking a box before payment.
They also govern the sale of photographic equipment, new and second-hand, ordered and paid for on this site. The studio's other services (weddings, portraits, businesses) are the subject of a quotation and of separate terms.
2. The seller
ELLE ET LUI PHOTOGAPHIE, SAS au capital de 3 000 €, RCS Paris 493 916 472, intra-community VAT FR29493916472, whose registered office is at 27 rue Ballu, 75009 Paris. Lessons take place at the studio, 59 rue Condorcet, 75009 Paris. Telephone: 01 53 21 01 42. Email: boutique@leica-montmartre.com.
3. The goods
The site sells new and second-hand photographic equipment: camera bodies, lenses, sport optics, bags and accessories. Each listing states the brand, the manufacturer's reference, the condition and the price.
Photographs and descriptions are given as a guide and do not form part of the contract; only the essential characteristics stated on the listing bind the seller. A second-hand piece is a single item, described in the condition it is in, and checked by the shop before being offered for sale.
4. Availability
The quantities shown are those counted in the shop. An unavailable reference cannot be ordered. Should an item become unavailable between your order and its preparation, you are informed without delay and refunded in full for that item within fourteen days.
5. Ordering and paying for equipment
Orders are placed online: filling the basket, entering your details, choosing collection or delivery, accepting these terms, then paying in full by card. Payment is handled by Stripe; the site keeps no card number.
The sale is concluded on receipt of payment. An email summarising the items, the price and the method of handover is sent to you, together with the invoice. Until payment is confirmed, the items are not reserved.
6. Collection and delivery
You choose between collection at the shop, 59 rue Condorcet, 75009 Paris, free of charge, and home delivery by Colissimo, signed for on receipt, to the address you give. Delivery charges depend on the total of the items ordered, VAT included; they are shown again before payment:
- under €500.00: €18.00
- from €500.00 to under €1,000.00: €24.00
- from €1,000.00 to under €3,000.00: €30.00
- from €3,000.00 to under €5,000.00: €60.00
- from €5,000.00 to under €8,000.00: €115.00
- from €8,000.00 to under €15,000.00: €150.00
- €15,000.00 and above: €180.00
The order is dispatched within 2 working days of receipt of payment, with a tracking number. In any event, it is delivered to you within a maximum of thirty days from the conclusion of the contract (article L216-1 of the French Consumer Code). After that period you may give us notice to deliver within a further reasonable time and then, failing delivery, terminate the contract by registered letter or in writing on another durable medium; the sums paid are then refunded to you within fourteen days at the latest.
Ownership passes only on payment of the full price. The risk of loss or damage passes when you take physical possession of the goods (article L216-4 of the French Consumer Code).
7. Right of withdrawal on equipment
You have fourteen days from receipt of the goods to withdraw without having to give a reason (articles L221-18 et seq. of the French Consumer Code). Simply tell us by an unambiguous statement, by email to boutique@leica-montmartre.com or by post to the registered office, stating your name and your order reference.
The goods must be returned to us, or brought back to the shop, no later than fourteen days after that statement, complete, in their original packaging and with their accessories. Return postage is at your expense. The refund is made within fourteen days at the latest of the goods being recovered or of proof of their dispatch, by the same means of payment.
You may be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and proper working: trying a camera body as you would in the shop raises no difficulty; using it on assignment for a fortnight does.
The right of withdrawal does not apply to goods made to your specifications or clearly personalised, nor to audio or video recordings or software unsealed after delivery (article L221-28 of the French Consumer Code).
8. Legal guarantees
The consumer has two years from delivery of the goods to obtain the benefit of the legal guarantee of conformity should a lack of conformity appear. During that period the consumer need only establish that the lack of conformity exists, not the date on which it appeared.
The legal guarantee of conformity requires the trader, where applicable, to supply all updates needed to keep the goods in conformity. It gives the consumer the right to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
Where the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee. Where the consumer asks for repair but the seller imposes replacement, the legal guarantee of conformity runs afresh for two years from the date of replacement.
The consumer may obtain a reduction of the purchase price and keep the goods, or end the contract and be refunded in full against return of the goods, where repair and replacement are impossible, or cannot be carried out within one month of the consumer's complaint, or would cause the consumer major inconvenience.
Termination of the contract is not, however, available where the lack of conformity is minor.
For second-hand goods, the period during which the defect is presumed to have existed at delivery is twelve months (article L217-7 of the French Consumer Code).
You also benefit from the guarantee against hidden defects under articles 1641 et seq. of the French Civil Code: the claim must be brought within two years of discovering the defect, and you may then choose between rescinding the sale and a reduction of the price.
These guarantees are exercised with us, at the shop address or by email, at no cost to you.
9. Commercial guarantees
New equipment also carries the manufacturer's commercial guarantee, whose duration and terms are set out in the documentation supplied with it.
Second-hand items come with a 3-month commercial warranty from the shop, running from delivery or collection, covering repair or, failing that, replacement or refund of the item in the event of a malfunction, excluding normal wear, accident and misuse. It is exercised with us, at the shop address or by email, on presentation of the invoice.
These commercial warranties are in addition to the legal guarantees and do not replace them.
10. Prices and value added tax
Prices are shown in euros, all taxes included, excluding delivery charges. The price that applies is the one displayed at the time of the order.
Second-hand items are sold without VAT shown: no tax is stated separately on their invoice, and none can be reclaimed by the buyer.
11. The photography lesson
The lesson is a private session, one to one with a photographer from the studio, on the date and at the time chosen when booking from the slots offered. Its content adapts to the pupil's level and equipment; it is described on the page photography lessons.
The pupil brings their own camera if they have one. The lesson is intended for adults; a minor may take part accompanied by a parent, or with their written permission.
12. Price
The lesson is sold at €300.00, with no value added tax. The applicable price is the one shown on the site at the time of booking. It covers the session and nothing else: no travel, equipment or prints are included unless expressly stated.
13. Booking and payment
Booking is done online: choosing a slot, entering your details, accepting these terms, then paying in full by bank card. Payment is handled by Stripe, our payment provider; the site keeps no card number.
The booking is firm once payment is received. A confirmation setting out the date, time, place and amount paid is sent by email, together with the invoice. Until payment is confirmed, the slot is not held.
14. Right of withdrawal
In accordance with articles L221-18 and following of the French Consumer Code, you have fourteen days from the booking (or from the purchase of a gift voucher) to withdraw, without having to give a reason. You need only tell us in an unambiguous statement, by email to boutique@leica-montmartre.com or by post to the registered office, quoting your name and the date of the lesson. The refund is made no later than fourteen days after your request is received, by the same means of payment.
If the lesson takes place before the end of that fourteen-day period, you expressly ask us, at the time of booking, to perform the service before the period expires, and you acknowledge that once the lesson has been given in full, the right of withdrawal can no longer be exercised (article L221-28, 1° of the French Consumer Code). This request is collected by a tick box at the time of booking.
A gift voucher already used for a lesson that has taken place can no longer give rise to withdrawal.
15. Postponement and cancellation
Things come up. You may ask to move the lesson to another date, free of charge, up to 48 hours before the scheduled time, by email or telephone; a new date is offered subject to the studio's availability. After that, or if you do not attend, the session is payable and can neither be moved nor refunded, save for the right of withdrawal under article 14 or a case of force majeure.
If the studio has to cancel or move a lesson (illness, the photographer being unavailable, force majeure), you are told as early as possible and you choose between a new date and a full refund.
16. Gift vouchers
A gift voucher entitles the holder to a photography lesson as described in article 11. It is paid for online at the price of the lesson in force on the day of purchase, and sent by email to the buyer with a unique code.
The voucher is valid for 6 months from purchase; the expiry date appears on the voucher. It is used by arranging a date with the studio, by phone, in the shop or by email; when a session is open on this site, it can also be booked there by entering its code at the payment step. After its expiry date it can no longer be used or refunded. A voucher cannot be exchanged for cash, nor split; it may be passed on to anyone you choose.
17. Liability
The studio undertakes to give the lesson with the care and skill expected of a professional; as regards the pupil's progress, it is bound by an obligation of means and not of result. The pupil remains responsible for their own equipment during the session. The studio cannot be held liable for damage arising from inaccurate information given at the time of booking, or from a case of force majeure.
18. Personal data
The data collected when booking is used to perform the service, to invoice it and to reach you. Its processing is described in our privacy policy.
19. Complaints and mediation
For any complaint, write to us at boutique@leica-montmartre.com or to the registered office: we look first for an amicable solution, and reply within one month.
If the disagreement continues, you may refer the matter free of charge to the consumer ombudsman the company belongs to, within the year following your written complaint: CM2C, 49 rue de Ponthieu, 75008 Paris, www.cm2c.net.
20. Governing law
These terms are drawn up in French and governed by French law. This English text is a translation provided for convenience; in the event of any difference, the French version prevails. Failing an amicable solution or mediation, any dispute falls to the courts having jurisdiction under the French Code of Civil Procedure; a consumer may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under that code, or before the court of the place where they lived at the time of booking.
